These Terms and Conditions govern your use of the MaltaGuru platform (“the Service”). By accessing or using the Service, you agree to comply with these Terms.

This Privacy Policy describes how the personal data you provide to us as a User through the public and private areas, as applicable, of the MaltaGuru website (henceforth, the "Website") is collected, used, stored, shared and protected. Your personal data will be processed effectively, proportionally and responsibly, in strict compliance with the General Data Protection Regulation (EU) 679/2016 ("GDPR"), Act 3/2018 on Personal Data Protection and Guarantee of Digital Rights ("LOPDGDD"), and other regulations that may apply. What personal information will we process?
We manage your personal data in order to provide the services you have requested through your interactions on the Website when we request certain personal information. The personal data we process may include but are not limited to: your first name, surname(s), email, profile photograph, user identification, password, telephone number, complete information of the property you are going to advertise (including its physical address), browsing data, bank details and/or billing data. All the fields indicated with an asterisk (*) in forms are compulsory. If not provided or provided incorrectly, it may be impossible to provide the services requested, without detriment to the ability to continue viewing the content of the Website and/or mobile app.

The list of services you can request and we can provide includes:

Management of MaltaGuru user registrations, so you can access our platform and benefit from MaltaGuru services, administering your user account. The legitimate basis shall be the execution of a contract. If you choose to register with MaltaGuru using your Google account, you will be directed from our platform to the Google website, where you will have to enter your account login details. The data we obtain from Google will be used to configure your MaltaGuru account. This means we will use your Google username as your username for MaltaGuru, and this will be visible to other users of the Website, as applicable. Any other data obtained from Google will not be visible to other users of the platform. You may dissociate your account from your Google profile at any time. By registering an account with MaltaGuru, you consent to receive newsletters, marketing materials, promotional messages, and other information we may send. You may opt out at any time by using the unsubscribe link provided in our messages or by contacting us.

If you decide to purchase any product or service through MaltaGuru (“Purchase”), it may be necessary to provide specific payment details including: credit card number, expiration date, billing address, and shipping details. You confirm that: (i) you are authorised to use the selected payment method, and (ii) the information you provide is accurate, complete and up-to-date. MaltaGuru may use third-party payment processors. By submitting your payment information, you authorise us to share it with these third parties under our Privacy Policy. We reserve the right to refuse or cancel an order for reasons including: product availability, errors in price or description, errors in your request, suspected fraud, unauthorised use, or illegal activity.

Any contests, sweepstakes, or promotions (“Promotions”) made available through MaltaGuru may be governed by rules separate from these Terms of Service. If you participate in any Promotion, you must review the applicable rules and our Privacy Policy. In the event of a conflict between these Terms and the Promotion rules, the Promotion rules shall apply.

Certain parts of MaltaGuru are billed on a subscription basis (“Subscription(s)”). Billing is made in advance on a recurring periodic basis (“Billing Cycle”), usually monthly. Subscriptions renew automatically under the same conditions unless cancelled by you or by MaltaGuru. You may cancel your Subscription renewal via your user account or by contacting our support team. A valid payment method is required. By submitting billing information, you authorise MaltaGuru to charge all fees incurred via your account. Should automatic billing fail, we will issue an electronic invoice requesting manual payment.

MaltaGuru may modify Subscription fees at any time. Any fee change will take effect at the end of the ongoing Billing Cycle. You will receive reasonable prior notice to allow you to cancel your Subscription if you do not wish to accept the new fees. Continued use of the service after the fee change implies acceptance of the modified price.

Except where legally required, all paid Subscription fees are non-refundable.

MaltaGuru allows you to post, link, store, share, and otherwise make available text, images, videos, graphics or other materials (“Content”). You are solely responsible for the Content you post, including its legality, accuracy, reliability and appropriateness. By posting Content, you confirm that: (i) the Content is yours or you have permission to use it, (ii) the Content does not infringe privacy rights, copyrights, publicity rights, contract rights or any third-party rights. We may terminate accounts that infringe copyright. You retain all rights to your Content, but grant MaltaGuru a licence to use, modify, display, reproduce and distribute it through the service, and to make it available to other users. Content found on the service belongs to MaltaGuru or third parties with permission; reproduction or commercial use is prohibited without written consent.

How long will we keep your personal data?

While you are a MaltaGuru user and use our services, your data will be kept for the duration of the contractual and commercial relationship with us. When processing is based on consent, data will be kept until you withdraw your consent. In legally established cases, we will process your data until you request deletion, without prejudice to retaining them for the time necessary to comply with legal obligations and statute-of-limitations periods. Suitable security measures will be applied throughout the entire storage period to prevent destruction, loss, alteration, or unauthorised access. Before definitive deletion, your data will be blocked once the purpose has ended, strictly for responding to potential liabilities during legal limitation periods.

MaltaGuru may provide references or access to third-party services we believe may be of interest to you. These services are accessed via links to external websites. The service will be provided directly by those third parties, and MaltaGuru is not responsible for the processing they carry out nor does MaltaGuru transfer any personal data to them. You must review and accept the respective privacy policies of such third-party services before providing any personal data.

Who are your data communicated to?

MaltaGuru only shares or provides your data to third parties to the extent necessary and permitted by current regulations. Your data may be communicated to:

• Other MaltaGuru users when you decide to contact an advertiser; your contact data will be shared with the advertiser associated with the listing.

• External experts or real estate agents when you expressly request help or consultancy. Data transfers always require your prior consent.

• Trusted suppliers and service providers who assist us in operating MaltaGuru. These entities may access personal data strictly for service provision and are bound by confidentiality and data protection agreements. Some suppliers may be located outside the EEA, meaning your data may be subject to international transfer. In such cases, adequate legal safeguards are applied, such as EU Standard Contractual Clauses ensuring an equivalent level of data protection.
