Please read these Terms and Conditions carefully before using the MaltaGuru platform. By accessing or using our Malta property platform, you agree to comply with and be bound by these terms. If you disagree with any part, you must discontinue use immediately.

Platform Usage Agreement

These Terms and Conditions govern your use of the MaltaGuru platform ("the Service"). By accessing or using the Service, you agree to comply with these Terms.

Data Protection and GDPR Compliance

This Privacy Policy describes how the personal data you provide to us as a User through the public and private areas of the MaltaGuru website is collected, used, stored, shared and protected. Your personal data will be processed effectively, proportionally and responsibly, in strict compliance with the General Data Protection Regulation (EU) 679/2016 ("GDPR"), Act 3/2018 on Personal Data Protection and Guarantee of Digital Rights ("LOPDGDD"), and other applicable regulations.

You, as a User, must guarantee: (a) the authenticity and veracity of all data you communicate through the Website or mobile app; (b) that you are the owner of this personal data; and (c) that you will keep the information provided up to date. You shall be the only party liable for any false or inexact statements made.

The list of services you can request and we can provide includes management of user registrations, account configuration, property search saving, direct contact with advertisers, notification management, property listing publication, and instant messaging between users.

User Registration and Service Access on MaltaGuru

Management of MaltaGuru user registrations so you can access our Malta property platform and benefit from MaltaGuru services. The legitimate basis shall be the execution of a contract.

If you register with MaltaGuru using your Google account, the data obtained from Google will be used to configure your MaltaGuru account. You may dissociate your account from your Google profile at any time. The collection and use of these data are based on your consent.

Prevention of abuse and fraud in the use of our services (for example, fraudulent activities, denial-of-service attacks, sending of spam). The legitimate basis shall be legitimate interest.

Compliance with Legal Obligations and GDPR

Ensuring compliance with all obligations set out in applicable regulations, including assisting in the exercise of data subjects' rights as recognised in relevant legislation. If necessary, we will use your information as required to meet our legal obligations. The legitimate basis shall be the fulfilment of a legal obligation.

Purchases and Payment Processing

If you purchase any product or service through MaltaGuru, it may be necessary to provide specific payment details including credit card number, expiration date, billing address and shipping details.

You confirm that: (i) you are authorised to use the selected payment method, and (ii) the information you provide is accurate, complete and up-to-date. MaltaGuru may use third-party payment processors. By submitting your payment information, you authorise us to share it with these third parties under our Privacy Policy.

We reserve the right to refuse or cancel an order for reasons including: product availability, errors in price or description, suspected fraud or unauthorised use.

Contests, Sweepstakes and Promotions

Any contests, sweepstakes or promotions ("Promotions") made available through MaltaGuru may be governed by rules separate from these Terms. If you participate in any Promotion, you must review the applicable rules and our Privacy Policy. In the event of a conflict between these Terms and the Promotion rules, the Promotion rules shall apply.

Subscriptions and Billing Cycles

Certain parts of MaltaGuru are billed on a subscription basis. Billing is made in advance on a recurring periodic basis ("Billing Cycle"), usually monthly. Subscriptions renew automatically under the same conditions unless cancelled by you or by MaltaGuru.

You may cancel your Subscription renewal via your user account or by contacting our support team. A valid payment method is required. Should automatic billing fail, we will issue an electronic invoice requesting manual payment.

Fee Changes Policy

MaltaGuru may modify Subscription fees at any time. Any fee change will take effect at the end of the ongoing Billing Cycle. You will receive reasonable prior notice to allow you to cancel your Subscription if you do not wish to accept the new fees. Continued use of the service after the fee change implies acceptance of the modified price.

Refunds Policy

Except where legally required, all paid Subscription fees are non-refundable. For questions about billing, please contact our support team.

User-Generated Content Policy

MaltaGuru allows you to post, link, store, share and make available text, images, videos, graphics or other materials ("Content"). You are solely responsible for the Content you post, including its legality, accuracy and appropriateness.

By posting Content, you confirm that: (i) the Content is yours or you have permission to use it, and (ii) the Content does not infringe privacy rights, copyrights, publicity rights or any third-party rights.

You retain all rights to your Content, but grant MaltaGuru a licence to use, modify, display, reproduce and distribute it through the service. Content found on the service belonging to MaltaGuru or third parties may not be reproduced or used commercially without written consent.

Data Retention and Deletion Policy

While you are a MaltaGuru user, your data will be kept for the duration of the contractual and commercial relationship with us. When processing is based on consent, data will be kept until you withdraw your consent.

Before definitive deletion, your data will be blocked once the purpose has ended, strictly for responding to potential liabilities during legal limitation periods. Suitable security measures will be applied throughout the entire storage period.

Third-Party Links and Data Sharing

MaltaGuru may provide references or access to third-party services we believe may be of interest to you. These services are accessed via links to external websites. MaltaGuru is not responsible for the processing they carry out nor does MaltaGuru transfer any personal data to them. You must review and accept the respective privacy policies of such third-party services before providing any personal data.

Who Are Your Data Communicated To?

MaltaGuru only shares your data with third parties to the extent necessary and permitted by current regulations. Your data may be communicated to:

  • Other MaltaGuru users when you decide to contact an advertiser; your contact data will be shared with the associated advertiser.
  • External experts or real estate agents when you expressly request help or consultancy. Data transfers always require your prior consent.
  • Trusted suppliers and service providers who assist us in operating MaltaGuru, bound by confidentiality and data protection agreements. Some suppliers may be located outside the EEA — in such cases, adequate legal safeguards apply, such as EU Standard Contractual Clauses.
  • Public authorities, police forces, courts and regulatory bodies when legally required.

User Rights – Access, Rectification and Deletion

  • Right to request confirmation of whether MaltaGuru is processing your personal data.
  • Right to access your personal data and request rectification of inaccurate information or deletion when no longer necessary.
  • Right to request restriction of processing in certain circumstances.
